There are also microscopic eavesdroppers available, which can be installed anywhere, e.g., in an electrical socket, lamp, or car. In addition, there are also more sophisticated devices for eavesdropping through walls (so-called seismic and stethoscopic eavesdroppers) and even special phone apps for monitoring calls and messages.

Who is being eavesdropped on?

While eavesdropping devices used to be available almost exclusively to secret services and police officers, today they can be purchased by anyone, easily over the internet. Therefore, the circle of those who may be eavesdropped on has expanded. They now include not only people suspected of committing crimes but also ordinary citizens, such as:

    • politicians,
    • individuals in important positions, e.g., in government offices,
    • businesspeople,
    • private persons – e.g., spouses suspected of infidelity.

Usually, eavesdropping is done by people who want to gain some unknown information, for example, about the business plans of competitors. However, sometimes it is about obtaining discrediting information about the individual being eavesdropped on, which may later be used, for instance, for blackmail. This is why it is worth knowing how to defend against this practice and understanding that effective eavesdropping detection is possible.

Are wiretaps legal?

From a legal point of view, wiretapping is not always illegal. Article 267 of the Criminal Code provides for penalties only for persons who obtain information not intended for them through such means. It is therefore illegal, above all, to eavesdrop on conversations in which one does not participate. Such actions are punishable by criminal liability, including imprisonment of up to two years.
On the other hand, it is not a crime to record one’s own conversations with others. However, if the person being recorded is unaware of the recording, they may later bring a civil action for infringement of personal rights.

What exactly does eavesdropping detection involve?

Due to the varying forms of eavesdropping devices, detecting them can be challenging. Bugs can be microscopic in size and planted almost anywhere, making it practically impossible to locate and identify them on your own. For this reason, it is best to entrust detection to specialists who employ the right techniques and tools. This task is professionally handled by a private detective who performs a range of activities to track down an eavesdropping device, typically divided into two stages:

    • a preliminary analysis of the situation – this step aims to determine the potential location and type of bug, which requires obtaining information from the client about the purpose and potential source of the eavesdropping,
    • physical search of the premises using specialised equipment.

Effective bug detection requires the specialised equipment mentioned above, which includes advanced and highly sensitive detectors. A good detective uses only professional-grade equipment capable of detecting the smallest bugs, even those that are temporarily switched off, damaged, or hidden in surprising locations. This equipment can also locate not only standard voice recorders but also spy cameras and GPS locators.

Detectors sold online for a few dozen zlotys lack these capabilities, so a negative result from using them may be misleading.
